Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of Airwave Inbox, operated by API Boutique Limited, a company registered in England and Wales ("we", "us", "our").
By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Airwave Inbox.
2. The service
Airwave Inbox is a unified messaging inbox for radio stations. It aggregates listener messages from channels such as WhatsApp, SMS, and email into a single dashboard for producers and presenters.
We may update, modify, or discontinue features of the service at any time. We will provide reasonable notice of material changes where practicable.
3. Accounts
To use Airwave Inbox, you must be invited by a station administrator. You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorised access
We may suspend or terminate accounts that violate these Terms or are inactive for an extended period.
4. Acceptable use
You agree not to use Airwave Inbox to:
- Send or facilitate unsolicited bulk messages (spam)
- Transmit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
- Violate the rights of any third party, including intellectual property and privacy rights
- Attempt to gain unauthorised access to the service, other accounts, or connected systems
- Interfere with or disrupt the service or its infrastructure
- Use the service in any way that violates applicable laws or regulations
- Violate the terms of any connected messaging platform (e.g. WhatsApp Business Policy, Meta Platform Terms)
5. Data ownership
Your content: Radio stations retain ownership of all listener messages, media, and data processed through Airwave Inbox. We do not claim ownership of your content.
Our role: We act as a data processor on the station's behalf. See our Privacy Policy for details on how data is handled.
Export: You may request an export of your station's data at any time by contacting support@airwaveinbox.com.
6. Third-party integrations
Airwave Inbox connects to third-party messaging platforms. Your use of those platforms is subject to their own terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
If you connect a WhatsApp Business Account, you must comply with Meta's WhatsApp Business Policy and applicable messaging guidelines.
7. Service availability
We aim to keep Airwave Inbox available at all times but do not guarantee uninterrupted or error-free service. The service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
We are not liable for any loss or damage arising from service downtime or interruptions.
8. Fees and payment
Airwave Inbox is currently in early access. If we introduce paid plans, we will give you at least 30 days' notice and you will have the option to cancel before charges apply.
9. Intellectual property
The Airwave Inbox service, including its design, code, and branding, is owned by API Boutique Limited. These Terms do not grant you any right to use our trademarks, logos, or branding without written permission.
10. Limitation of liability
To the fullest extent permitted by law, API Boutique Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim, or £100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless API Boutique Limited from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your content, or your breach of these Terms.
12. Termination
You may stop using Airwave Inbox at any time by contacting your station administrator or emailing us.
We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Where possible, we will provide reasonable notice.
Upon termination, your right to use the service ceases. Sections relating to data ownership, limitation of liability, indemnification, and governing law survive termination.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered station users at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
